1. Acceptance of Terms
Welcome to banyanrisk.com (the “Site”), which is owned and operated by Banyan Risk Ltd., a company incorporated in Bermuda and regulated by the Bermuda Monetary Authority (“BMA”). References to the “Banyan Group” mean Banyan Risk Ltd. and its affiliates and subsidiaries in Bermuda, Canada, the United States and the United Kingdom (together, “Banyan,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms of Use (the “Terms”). If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, you must not use the Site.
We may update these Terms from time to time by posting a revised version on this page. Changes are effective when posted, unless we state otherwise. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
These Terms apply only to your use of the Site. Any insurance policy, binder, endorsement, quotation, or other insurance documentation is issued by an insurer (or its authorized representative) and is governed exclusively by its own terms and conditions.
We may provide additional terms, notices, or guidelines on the Site (for example, for specific portals, downloads, events, or services). Those additional terms become part of these Terms by reference.
2. Informational Use and Underwriting Role
This Site is provided for general informational purposes only. Content on the Site is not intended to be, and should not be construed as, legal, regulatory, tax, investment, or insurance advice.
The Banyan Group may operate as an insurance intermediary and/or as a managing general agent, underwriting agent, or general agent, providing underwriting and related services on behalf of insurers and reinsurers that are authorized, licensed, approved, or otherwise permitted/eligible under applicable law. Those insurers/reinsurers provide the underwriting capital and issue (or authorize the issuance of) insurance policies. Unless expressly stated in writing, Banyan Group entities do not act as insurers and do not assume insurance risk.
The Site may describe insurance products, programs, underwriting capabilities, and market commentary. Such descriptions are provided solely for informational purposes and do not constitute an offer, solicitation, recommendation, endorsement, or advice to purchase insurance. Any coverage is subject to underwriting review, insurer terms, conditions, and exclusions, and applicable laws and regulations, and may not be available in all jurisdictions.
Nothing on the Site is intended to be, or should be treated as, a “financial promotion” or other invitation or inducement to engage in insurance distribution activities where such a communication would be restricted. If you are a retail customer/consumer, you should speak with a suitably licensed insurance intermediary regarding your specific insurance needs.
3. Inquiries and Submission Process
The Site does not support (and cannot be used for) the binding of insurance coverage. The Site may allow you to submit general inquiries (for example, through email links, telephone numbers, or contact forms). Any information you submit through the Site is not an application for insurance and does not create or evidence insurance coverage.
Users may contact the Banyan Group to make general inquiries regarding underwriting capabilities or products. Any insurance submission, quotation, placement request, or appointment of intermediary must occur outside of the Site (including through customary broker channels), is subject to underwriting review, insurer approval, applicable laws and regulations, and is governed exclusively by the terms of formal documentation issued by the applicable insurer (and, where applicable, the terms agreed with the relevant intermediary). Do not send bank account details, payment card information, passwords, or highly sensitive personal information through the Site. Communications via the internet may not be secure.
4. Regulatory and Licensing Disclosures
Banyan Risk Ltd. is incorporated in Bermuda and regulated by the Bermuda Monetary Authority. Other members of the Banyan Group may be licensed, registered, or otherwise regulated by insurance and/or financial services regulators in the jurisdictions in which they operate, including Canada, the United States and the United Kingdom.
Insurance products and services are offered only where and when permitted under applicable law, and may be available only through appropriately licensed insurance intermediaries. Certain placements may be made with insurers that are not admitted in a particular jurisdiction (for example, on a surplus lines or non-admitted basis) and may not be protected by policyholder compensation or guarantee funds.
Further jurisdiction-specific disclosures (including, where applicable, licensing and register details and required notices) are provided on the Site where relevant or upon request.
5. No Reliance; Accuracy of Information
While we strive to keep the Site current, the Site may contain inaccuracies, omissions, or information that is out of date. We do not warrant that the information on the Site is complete, accurate, or up to date.
You agree that your use of, or reliance on, information from the Site is at your sole risk. You should obtain independent advice appropriate to your circumstances before taking (or refraining from taking) any action based on information from the Site.
6. Intellectual Property and Permitted Use
The Site and all content, features, and functionality on the Site (including text, graphics, logos, icons, images, audio clips, video, and software) are owned by, or licensed to, the Banyan Group and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business purposes, subject to these Terms. You may not copy, modify, create derivative works from, distribute, publicly display, publicly perform, republish, download, store, transmit, sell, rent, lease, reverse engineer, decompile, or exploit any portion of the Site except as expressly permitted by these Terms or with our prior written consent.
All trademarks, service marks, trade names, and logos displayed on the Site are the property of their respective owners. Nothing in these Terms grants any right to use any such marks without the owner’s prior written permission.
7. Acceptable Use
You agree not to use the Site in any manner that could disable, overburden, damage, or impair the Site, interfere with any other party’s use of the Site, or introduce any viruses, malware, or other harmful code.
You agree not to attempt to gain unauthorized access to the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site; to probe, scan, or test the vulnerability of any system or network; or to breach any security or authentication measures.
You agree not to use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission, except as may be permitted by applicable law and in accordance with a published robots.txt file (if any).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE BANYAN GROUP OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED USD 100 (OR THE EQUIVALENT IN LOCAL CURRENCY).
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (INCLUDING LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, TO THE EXTENT SUCH LIMITATION IS PROHIBITED).
12. Indemnification
You agree to indemnify, defend, and hold harmless the Banyan Group and its directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) your submission of any information or materials through the Site.
13.Privacy and Cookies
Our collection and use of personal information in connection with the Site are described in our Privacy & Cookies Policy, which is incorporated into these Terms by reference.
14. Changes to the Site; Suspension and Termination
We may modify, suspend, or discontinue the Site (in whole or in part) at any time without notice.
We may suspend or terminate your access to the Site at any time if we reasonably believe that you have violated these Terms or that your use of the Site creates risk for us or others.
15. Governing Law and Jurisdiction
These Terms (and any dispute or claim arising out of or in connection with them or the Site) are governed by the laws of Bermuda, without regard to conflict of law principles.
You agree that the courts of Bermuda will have exclusive jurisdiction over any dispute or claim arising out of or relating to these Terms or the Site, except to the extent that applicable law provides otherwise (including mandatory consumer protection laws that may apply based on your habitual residence).
